I would like to resolve this out of court but it does not seem possible. I am trying to speak to my legislators to draft a bill so this banning issue for no reason does not happen to someone else. Please can you help me with this issue. I have contacted Tara Edmonds but she has not reply.
Dear Ms. Edmonds and Ms. Fitch
I am writing to talk about the permanent banning of my sister Barbara Cavelius in a letter from your attorney dated March 1, 2023. As you are aware the two legal actions brought against me by your attorney have been ruled in my favor by the judges. In the matter of the permanent ban of my sister Barbara Cavelius, the proper legal procedures were not followed. We feel confident the ban would be set aside in court, but hope we can resolve this issue out of court and without more attorney fees.
The only two written complaints against my sister, that were presented as evidence, were authored by Betsy Brignola and Mary Johnston, I believe they should be dismissed. The complaint written on Dec 11th about my sister and her dogs is a perfect example of false allocations made by Ms. Brignola. I have proof that on Dec 11th Barbara and my family were not even home that evening when Betsy wrote the alleged complaint and testified in court against my family. This is just ONE example of the many false complaints Mary and Betsy have written against me and my family. They both perjured themselves in court with the intent to cause harm to my family.
According to 13. General Conduct
Residents making complaints to management concerning alleged violations of any rule or regulation that are written and signed will be investigated. When found to be valid, the offending party shall be informed in writing concerning the alleged violation and given a reasonable opportunity to respond to the complaint. If the offending party does not respond, and/or the violation continues, this may constitute cause for termination of the Rental Agreement.
I was never given an opportunity to respond to the complaint before my sister was banned. The alleged incident was never investigated. The fact that HTA sent the initial official banning letter to my deceased mother Barbara Martin when they intended to send it to my sister clearly shows it was not investigated.
7016. Termination or nonrenewal of rental agreement by landlord; due cause: noncompliance.
· (a) A landlord may terminate a rental agreement with a tenant immediately upon written notice if the tenant does not comply with the terms of the rental agreement or the requirements of this subchapter and the noncompliance is the result of any of the following:
(1) Clear and convincing evidence that conduct of the tenant or of a resident of the tenant’s manufactured home caused, is causing, or threatens to cause, immediate and irreparable harm to any person or property in the manufactured home community.
I have evidence and a witness that will testify that Betsy started an argument with my sister the evening of February 16, 2023, while my sister was talking on her phone. Betsy yelled mean things to Barbara as she was walking away from the situation. The missing edited video also shows that the letter I wrote you and Nancy dated May 3, regarding this encounter is accurate. Barbara who has been a member of this community for thirteen years, did not harm or threaten anyone or anything in the community. She defended herself against a hostile neighbor who initiated an argument on Feb 16th.
As I had hoped with scheduling the May 15, 2023 meeting with you, that we could have resolved this and other issues out of court. I am asking the Ban on my sister be officially and legally removed before Oct 26,2023. My family has not been able to properly celebrate my son’s high school graduation or my other son’s 21stbirthday with my sister, their aunt. We would like to all enjoy the Sea Witch Festival, Thanksgiving, Christmas, and my birthday while staying together in my home as we have done in previous years. Our family, especially my children, need to get back to some normalcy.
I would appreciate a response to this letter at your earliest convenience.
